What’s In Store For Shooter James Holmes [POLL][AUDIO]
So the burning question in our minds is what is going to happen to James Holmes. And why did he not kill himself? I can’t remember the last time someone did something like this and didn’t kill themselves in the end. This tells me, along with the smirk on his face and the way he was caught, that he wanted this so called ‘fame’ and wanted the attention for what he is about to go through. Is he really that crazy?
I think we all realize that his defense team will claim insanity and in fact that route is already being planned out. Legal Analyst Scott Robinson Saturday morning that Holmes is due in court Monday morning. Robinson says it will only be a simple advisement procedure.
I would suspect it’s too early for the defense to be raising competency – which will probably happen – and it’ll be too early for the prosecution to have charges together. [Holmes'] lawyer believes he is not competent to proceed – that is that he’s not able due to a mental defect or disorder to assist in the appropriation of his own defense. Then the defense lawyer has an absolute duty to raise competency and [request] a competency evaluation. – Scott Robinson
Don’t you just get sick and tired of people claiming this kind of defense? Seems to me James Holmes was plenty ‘competent’ when he rigged his apartment to blow sky high before he left on his shooting rampage. Seems like he was plenty ‘competent’ when he dressed himself up and loaded all his weapons making sure his AR-15 assault rifle, a shotgun, and two .40-caliber Glock handguns and gas grenades were ready to go. Seems like he was perfectly ‘competent’ to get himself to the movie theater and methodically kill 12 and wound another 58.
By law competency means whether the suspect actually knows what is going on and knows why they are in court facing charges. By the smile on his face during booking he seemed to be extremely ‘competent’ and the look told me he knew EXACTLY why he was being booked!
STOP THE INSANITY CRAP!
Since the charges will likely include at least 12 counts of ‘after deliberation – first-degree murder’ and 12 counts of ‘extreme indifference – first-degree murder,’ the stakes are high and the chance of the death penalty being on the table for Holmes is high.
James Holmes was a very smart man who was working on his Ph.D and now it’s a fact that if he gets away with “not guilty by reason of insanity” the death penalty won’t even come into play as we all know. He will be admitted to a State hospital until he is ‘safe for society.’
Can you imagine that? I am already furious and will dance in the street when they do in fact find James Holmes ‘COMPETENT.’
